Getting your privacy policy and terms written accurately is a one-time problem. Keeping them accurate as your product changes is an ongoing one.
This guide covers the specific product changes that cause compliance docs to go stale, what each doc type needs to stay current, and how to build a lightweight process that catches gaps before they matter.
Why Docs Go Stale Faster Than You Think
When a compliance doc is first written, it reflects the product at that moment. Vendors, data flows, AI features, and user-facing promises all get captured accurately.
The problem is that none of those things stay fixed. The product ships. New vendors get added. An AI API gets integrated. A data flow changes when two features are combined. Pricing tiers get restructured.
Most of these changes do not come with a compliance review built in. Developers add a new analytics tool during a sprint. Finance switches to a new payment processor. A product manager ships an AI-powered feature without checking whether the AI disclosure covers the new model.
Each change is small. Together, they build up into a meaningful gap between what your docs say and what the product does.
The Four Docs That Go Stale Most Often
Privacy policy
A privacy policy goes stale when:
- A new vendor is added that processes personal data (analytics, email, support, payments)
- The types of data you collect change (a new field, a new integration, a new feature)
- How you share or retain data changes
- You expand to a new market with different requirements (the EU, California, etc.)
- A vendor changes their infrastructure and your subprocessor list is out of date
What to watch: Any vendor that touches user data. Any new data field. Any change to data storage, retention, or sharing logic.
Terms of service
Terms of service go stale when:
- A new feature changes what users can or cannot do with the product
- A new pricing tier creates new obligations or restrictions
- You add a free tier, change a refund policy, or modify how accounts are terminated
- You add an AI feature that generates content, since terms often need to cover AI-generated output separately
- You expand into a new vertical or enterprise segment with different contract requirements
What to watch: Feature launches that change user permissions, pricing changes, and any AI feature that users interact with directly.
AI disclosures
AI disclosures are the newest category and the one most likely to be incomplete.
An AI disclosure goes stale when:
- You add a new LLM provider or switch from one model to another
- You add a new AI-powered feature that the current disclosure does not describe
- You use AI to process sensitive data (personal information, health data, financial data) that is not covered
- A vendor you use adds AI features to their product without announcing it prominently
- Your use of AI for content moderation, recommendations, or automated decisions changes
What to watch: Any AI API integration. Any vendor that may be adding AI to their product. Any feature that uses a model to process or generate output that users see.
Vendor/subprocessor disclosures
Subprocessor lists are a specific requirement under GDPR and are increasingly expected by enterprise buyers outside Europe.
A subprocessor list goes stale when:
- You add any vendor that processes EU personal data on your behalf
- A vendor is acquired or changes their infrastructure provider
- You remove a vendor but forget to update the list
- A vendor's subprocessors change (relevant if your customers need a complete chain)
What to watch: Every vendor addition or change. Vendor acquisition news. Any change to your cloud or infrastructure provider.
Building a Lightweight Review Process
You do not need a compliance team to keep docs current. You need a trigger-based process, one that fires when something relevant changes rather than on a fixed calendar.
Step 1: Define what triggers a review
Write down the specific events that should trigger a compliance review:
- Adding any new vendor that processes user data
- Launching any feature that uses AI or machine learning
- Changing how user data is stored, shared, or retained
- Launching in a new country or market
- Adding a new pricing tier with different terms
- A vendor you use being acquired or changing their infrastructure
Post this list somewhere visible. Make it part of your engineering and product onboarding so new team members know which changes need a compliance check.
Step 2: Assign an owner for each doc
Each of your compliance docs should have a named owner, someone responsible for keeping it accurate. This does not have to be a lawyer. It can be a founder, a head of product, or a VP of engineering who knows the product well.
The owner's job is not to write legal copy. It is to notice when the doc is out of date and coordinate the update.
Step 3: Check before you ship, not after
The cheapest time to catch a compliance gap is before a feature ships. A quick five-minute check at the end of a product sprint is far less expensive than catching a gap during a procurement review six months later. Ask: does this change anything in our privacy policy, terms, or AI disclosures?
This does not have to be formal. A checklist item in your sprint retro or a question in your feature sign-off process is enough.
Step 4: Keep a running vendor log
Maintain a simple list of every vendor that processes user data. Include:
- Vendor name
- What data they process
- Whether a DPA is signed (for GDPR purposes)
- When you last verified their subprocessor list
This log does not have to be elaborate. A shared spreadsheet or a Notion table is enough. The goal is to have a single place to check when something changes.
Step 5: Review the full set at least once a year
Even a good trigger-based process will miss things. An annual review, ideally with a lawyer who can check that the current docs still hold up, catches the gaps that accumulated between triggers.
Frame the annual review around questions, not just reading:
- What new vendors have we added in the last 12 months?
- What AI features have we shipped, and are they all covered in the AI disclosure?
- Have any of our existing vendors added AI features or changed their data practices?
- Does our privacy policy still accurately describe what data we collect and why?
- Are our terms consistent with how the product actually works today?
What to Do When You Find a Gap
Gaps are normal. Finding one is not a crisis. Leaving it uncorrected is.
When you find a gap:
- Document it with a specific note: what the doc says vs. what the product does
- Assess the risk: is this a gap that affects users materially, or a technical inaccuracy?
- Update the doc, or flag it to a lawyer if the required change is significant
- Add a process change so the same type of gap does not recur
Most gaps can be fixed with a targeted update to the relevant section. A one-time lawyer review is rarely required unless the change is significant or affects users' rights directly.
When Ongoing Monitoring Makes Sense
If your team is shipping frequently, with multiple features a month, new AI integrations, and regular vendor changes, a manual trigger-based process will miss things. Changes accumulate faster than any individual reviewer can track.
At that point, monitoring tools that watch for compliance-relevant changes and flag them automatically can close the gap. The goal is the same: catch gaps before they compound. Monitoring just removes the dependency on someone noticing.
The right approach depends on your shipping velocity, your compliance risk level, and how much enterprise scrutiny you face. For teams shipping frequently with AI features and enterprise buyers, ongoing monitoring is usually worth the overhead. For stable teams with low shipping velocity, a well-run manual process is often enough.
